This Privacy Policy describes how Loaded Boards, Inc., a California corporation doing business as Carver Skateboards ("Carver," "we," "us," or "our") collects, uses, and shares personal information when you visit, interact with, or make a purchase from carverskateboards.com (the "Site"). By using the Site, you agree to the practices described in this Policy.

Personal Information We Collect

When you visit the Site, we collect two general categories of information:

Device Information (Automatically Collected)

We automatically collect technical information about your device and browsing activity, including:

  • IP address and approximate geolocation derived from it

  • Pages viewed, products viewed, time spent on pages, and click behavior

Sensitive Personal Information. We do not intentionally collect categories of "sensitive personal information" as defined under California or other state laws (such as Social Security numbers, government IDs, precise geolocation, biometric data, or health information). Payment card numbers are processed directly by our payment processor and are not retained by us.

How We Collect Information

We collect information directly from you (when you make a purchase, fill out a form, or contact us) and automatically through the following technologies:

  • Log files: Track actions on the Site, including IP address, browser type, ISP, referring/exit pages, and date/time stamps.
  • Web beacons, tags, and pixels: Electronic files that record information about how you browse the Site, including pixels from advertising partners (e.g., Meta/Facebook, Google, TikTok).

How We Use Your Personal Information

We use the Personal Information we collect to:

  • Fulfill and ship your orders, process payments, and provide order confirmations and invoices
  • Communicate with you about orders, returns, customer service inquiries, and account matters
  • Screen orders and Site activity for fraud, security threats, or other unlawful activity
  • Provide marketing communications, promotions, and product recommendations (when you have opted in or consistent with applicable law)
  • Improve and optimize the Site, including through analytics and assessing the success of our marketing and advertising campaigns

How We Share Your Personal Information

We share your Personal Information with third-party service providers only as necessary to operate our business and provide services to you. Categories of recipients include:

  • E-commerce platform: Shopify powers our online store and processes order data. See Shopify's Privacy Policy.
  • Payment processor: Payments are securely processed by Shopify Payments, which is PCI-DSS compliant.
  • Shipping carriers: We share your name, address, and contact details with FedEx, UPS, USPS, DHL, and other carriers to deliver your orders.
  • Analytics providers: We use Google Analytics to understand how customers use the Site. See Google's Privacy Policy. You can opt out of Google Analytics here.
  • Advertising and marketing partners: We share certain identifiers with platforms such as Meta/Facebook, Google, TikTok, Shop, and Snapchat to deliver targeted advertisements and measure campaign performance.
  • Email and SMS marketing platform: We use Klaviyo to send marketing emails and text messages to customers who have opted in. See Klaviyo's Privacy Policy.
  • Customer reviews: We use Yotpo to collect and display customer product reviews. Your name (or initials) and review content may be displayed publicly on our Site. See Yotpo's Privacy Policy.
  • Legal compliance: We may disclose Personal Information to comply with applicable laws, respond to subpoenas or lawful requests, or protect our rights, property, or safety.
  • Business transfers: If we are involved in a merger, acquisition, or sale of assets, your Personal Information may be transferred as part of that transaction.

We do not sell your personal information to third parties for their own independent marketing purposes. However, our use of advertising partners (such as Meta/Facebook and Google for retargeting) may be considered "sharing" or "sale" under certain state privacy laws. You may opt out at any time as described in the Your Privacy Rights section below.

Mobile opt-in data is never shared. Information collected as part of SMS opt-in (your phone number and the consent record) is not shared with any third party for promotional or marketing purposes, with the sole exception of our SMS service provider used to deliver the messages.

Behavioral Advertising

We may use your Personal Information to deliver targeted advertisements or marketing communications that we believe may be of interest to you. You can opt out of targeted advertising through the following platforms:

Data Retention

We retain your Personal Information only as long as necessary for the purposes described in this Policy and to comply with our legal obligations:

  • Order records: Retained for up to 7 years to comply with tax, accounting, and warranty obligations.
  • Customer service communications: Retained for up to 3 years after the last interaction.
  • Email marketing data: Retained until you unsubscribe or for up to 2 years of inactivity, whichever comes first.
  • SMS opt-in records: Retained for the duration of your consent and for a reasonable period thereafter to demonstrate compliance.
  • Analytics data: Retained according to the default settings of our analytics providers (typically up to 26 months for Google Analytics).
  • Account information: Retained until you request deletion, subject to legal retention requirements.

You may request deletion of your Personal Information at any time as described in the Your Privacy Rights section below.

Security

We implement reasonable technical, administrative, and physical safeguards designed to protect your Personal Information, including SSL/TLS encryption for data transmitted to and from our Site and PCI-DSS compliant payment processing through our payment provider. Access to Personal Information is limited to authorized employees and service providers who need it to perform their job functions. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Data Breach Notification

In the event of a data breach that affects your Personal Information, we will notify affected individuals and relevant authorities as required by applicable law.

Your Privacy Rights

California Residents (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Right to know what Personal Information we collect, use, disclose, and share
  • Right to delete Personal Information we have collected from you, subject to certain exceptions
  • Right to correct inaccurate Personal Information
  • Right to opt out of the sale or sharing of your Personal Information for cross-context behavioral advertising
  • Right to limit the use of sensitive personal information (we do not intentionally collect this)
  • Right to non-discrimination — we will not discriminate against you for exercising your rights

Categories of Personal Information Collected and Disclosed. In the last 12 months, we have collected and disclosed the following categories of Personal Information under CCPA:

  • Identifiers (name, address, email, phone, IP address)
  • California customer records (billing and shipping information)
  • Commercial information (purchase history, product preferences)
  • Internet or other network activity (browsing behavior, cookie data)
  • Geolocation data (approximate location derived from IP address)

How to exercise your California rights. You may submit a verifiable consumer request through either of these methods:

We will need to verify your identity before processing your request. You may also designate an authorized agent to submit a request on your behalf, in which case we may require proof of authorization and verification of your identity.

Opting out of sharing for advertising. To opt out of cross-context behavioral advertising, you may use the platform-specific opt-out links in the Behavioral Advertising section above, send a request to privacy@carverskateboards.com, or enable the Global Privacy Control (GPC) signal in your browser.

Other U.S. State Residents

If you reside in a state with a comprehensive consumer privacy law — including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others — you may have similar rights to access, correct, delete, and obtain a copy of your Personal Information, as well as opt out of targeted advertising and the sale of your Personal Information. European Economic Area, United Kingdom, and Switzerland Residents (GDPR / UK GDPR)

If you are located in the EEA, UK, or Switzerland, you have the following rights under the General Data Protection Regulation:

  • Right to erasure ("right to be forgotten")
  • Right to restrict processing
  • Right to data portability

  • Right to withdraw consent at any time (without affecting prior processing)
  • Right to lodge a complaint with your local data protection supervisory authority

Legal bases for processing. We process Personal Information of EEA, UK, and Swiss residents on the following legal bases:

  • Contract: to fulfill our agreement with you (e.g., processing orders)
  • Consent: for marketing communications and certain cookies
  • Legitimate interests: for fraud prevention, security, and improving our Site (where these are not overridden by your rights)
  • Legal obligation: for tax, accounting, and other regulatory requirements

International transfers. Your Personal Information may be transferred to and processed in the United States, Canada, or other countries that may have different data protection laws than your country of residence. Where required, we use Standard Contractual Clauses or equivalent safeguards.

Children's Privacy

Our Site is not directed to children under the age of 13 (or under 16 for residents of the European Economic Area and the United Kingdom), and we do not knowingly collect Personal Information from children. If we learn that we have collected Personal Information from a child without verified parental consent, we will delete it. Mobile Messaging Terms and Conditions

By providing your mobile phone number and expressly consenting to receive text messages (typically by checking an opt-in box at checkout or on our Site), you agree to receive text messages from Carver at +1 (310) 648-8249 regarding account notifications, customer care, delivery updates, and marketing.

  • Consent is not a condition of purchase.
  • Message frequency may vary.
  • Message and data rates may apply.
  • Carriers are not liable for delayed or undelivered messages.

Mobile opt-in data is collected and stored separately and is never shared with third parties for marketing purposes (other than the SMS service provider used to deliver messages).

Do Not Track and Global Privacy Control

Do Not Track (DNT). Because there is no consistent industry standard for responding to "Do Not Track" browser signals, our Site does not currently change its behavior in response to DNT signals.

Global Privacy Control (GPC). We honor the Global Privacy Control signal where required by applicable law. When we detect a valid GPC signal from your browser, we treat it as a request to opt out of the sale or sharing of your Personal Information for cross-context behavioral advertising.
